23 JUDGE LIU: Mr. Stojanovic, what shall we do?

24 MR. STOJANOVIC: [Interpretation] I have also been caught off guard

25 a little. Thanks to the spirit of cooperation of the opposing party. Our

1 next witness did not ask for any protective measures, Ranko Dzokic, and

2 because of the arrangements with the VW unit he will be here this

3 afternoon. He does not have a direct flight from Belgrade. He's

4 travelling via Vienna. So we will have him here in the courtroom only

5 tomorrow afternoon. But with your permission, Your Honours, maybe this is

6 a good opportunity for me to give you some details about our forthcoming

7 schedule.

8 JUDGE LIU: Yes, of course. I'm very sorry to hear that we'll

9 lose at least two sessions of today. As you know, we are somehow behind

10 schedule, and during this week things -- the Milosevic case is not on, we

11 will have the availability of the courtroom and all the facilities. But

12 anyway, please brief us about your schedule.

13 MR. STOJANOVIC: [Interpretation] Thank you, Your Honour. As we

14 have indicated at the beginning of our case, we planned for the following

15 four witnesses, Vukotic, Maric, Bojanovic, and the witness who testified

16 yesterday and today be completed by today. Tomorrow, we have one witness.

17 On Thursday, we will have two witnesses, Minja Radovic and Brano Djuric,

18 members of the 4th Engineers Company of the Zvornik Brigade. And on

19 Friday, we will call a witness who is scheduled to testify for the whole

20 day. So in accordance with the previous list we planned to complete our

21 case with these witnesses which would be fully in accordance with the

22 schedule that we presented earlier to the Court. All other witnesses will

23 be very brief. Their testimonies will be quite short and will relate to

24 specific individual counts of the indictment. Thank you.

25 JUDGE LIU: Thank you. Yes, Mr. Karnavas.

1 MR. KARNAVAS: With respect to one other witness that was on

2 Mr. Stojanovic's list of witnesses, as I understand, one of the videolink

3 witnesses, an agreement has been reached between the Prosecution and

4 Mr. Stojanovic with respect to one portion of his statement coming in.

5 And in light of that portion of the statement and in light of the other

6 witness that will be available via videolink as it would appear, we -- and

7 in light of the fact that we had already withdrawn this witness from our

8 witness list, the Court should be aware that we certainly will not be

9 asking for this witness, that would be Mr. Vasic, to be appearing by

10 videolink. So that would be a savings of some time as well.

11 JUDGE LIU: Thank you very much for your cooperation. Thank you.

12 Yes, Mr. McCloskey.

13 MR. McCLOSKEY: Just one more issue: We have spoken to

14 Mr. Stojanovic about his military expert. And as with Mr. Karnavas's

15 military expert, we will not be objecting to the entry of the report, and

16 I believe Mr. Stojanovic is then agreeing not to call that witness either.

17 So that's another person that has been dealt with.

18 JUDGE LIU: Thank you very much. I'm very glad to hear that. I

19 believe that both parties showed their cooperation with the good faith.

20 We still have time left, so could we come to an ex parte hearing

21 because we want to hear the reports from Mr. Karnavas as well as from

22 Blagojevic himself about the contacts between them and to see what's the

23 result on that. Do you have any objections, Mr. McCloskey? I think the

24 best way is to conduct it in private session, ex parte hearing, because it

25 may touch upon the sensitive relationship between the counsel and his

1 client.

2 MR. McCLOSKEY: Yes. Absolutely, we agree. So the Prosecution

3 then will take its leave.

4 JUDGE LIU: Thank you very much for your cooperation.

5 Well, there's a suggestion that maybe the best way is to have a

6 short break.

7 Yes, Mr. Stojanovic.

8 MR. STOJANOVIC: [Interpretation] Your Honour, since Mr. McCloskey

9 believes that they should perhaps leave the courtroom because of this

10 meeting, we also think that it would perhaps be a good idea for our team

11 to withdraw as well in light of the procedure. But please, you make the

12 ruling.

13 [Trial Chamber and Registrar confer]

14 JUDGE LIU: Well, we have a break for 15 minutes, and we'll resume

15 at 9.30, only with Mr. Blagojevic and his counsel, Mr. Karnavas.

17 to be reconvened on Wednesday, the 14th day of

18 July, 2004, at 2.15 p.m.
