I, FAUSTO POCAR, Pre-Appeal Judge in this case;

NOTING the "Prosecution’s Request for Re-Consideration of Present Scheduling Order for Evidentiary Hearing and Request for Related Orders" ("Prosecution’s Request for Reconsideration") filed on 4 December 2003 and the "Appellant’s Response to Prosecution’s Request for Re-Consideration of Present Scheduling Order for Evidentiary Hearing and Request for Related Orders" filed on 5 December 2003 ("Appellant’s Response");

CONSIDERING that, given certain contents of the Prosecution’s Request for Reconsideration and the Appellant’s Response, these two documents should have been filed confidentially;

HEREBY ORDER as follows:

    1. Henceforth, both the Prosecution’s Request for Reconsideration and the Appellant’s Response shall be treated as confidential filings by any individual, group, or entity that has received it.

    2. Any individual, group, or entity that has knowledge of the Prosecution’s Request for Reconsideration and the Appellant’s Response and their contents shall not make any use of them and shall not disclose their contents to any other individual, group, or entity.

    3. Any violation of this order may constitute contempt of the International Tribunal, which is regulated by Rule 77 of the Rules of Procedure and Evidence of the International Tribunal.
