TRIAL CHAMBER I

PURSUANT to Articles 20 (4) and 22 of the Statute and Rules 75, 79 and 81 of the Rules of Procedure and Evidence (hereafter, "the Rules"),

CONSIDERING the preliminary application of the Prosecutor of 4 June 1996 seeking the non-disclosure of the identity of victims and witnesses,

CONSIDERING the application of the Prosecutor of 24 June 1996 seeking the non-disclosure of the statements of specific witnesses pursuant to Rules 72 and 75(A) of the Rules,

CONSIDERING the application of the Prosecutor of 30 August 1996 seeking measures of protection pursuant to Rule 69 of the Rules,

CONSIDERING the response of the Defence dated 18 September 1996 objecting to the applications of the Prosecutor,

CONSIDERING the response of the Prosecutor of 18 September 1996 regarding the objection of the Defence to its applications,

NOTING that the hearing of 18 September has been set to review the question of the hearing of an ex parte and in camera hearing on the possibility setting into place of measures of protection for the victims and witnesses;

NOTING that the Trial Chamber considers that information about the witnesses which might be mentioned or obtained during the hearing might permit the identification of the persons concerned by the measures of protection which have been requested; that the disclosure of that information to the public and to the media during a public hearing might jeopardise the privacy and safety of the victims and witnesses;

FOR THE FOREGOING REASONS,

ORDERS that the hearing set for 18 September 1996 at 14.30 hours be held in camera and that the press and public be excluded.

Done in French.
