I, Judge David Hunt, Pre-Trial Judge in this case;

NOTING the "Motion for the Provisional Release of Radoslav Brdanin" filed by counsel for Radoslav Brdanin (“Brdanin”) on 28 April 2000 (“Motion”) pursuant to which Brdanin seeks provisional release pursuant to Rule 65(B) of the Rules of Procedure and Evidence (“Rules”);

NOTING the "Prosecution’s Response to ‘Motion for the Provisional Release of Radoslav Brdanin (sic)" filed by the Office of the Prosecutor ("prosecution") on 9 May 2000 ("Response");

NOTING the request made by counsel for Brdanin in the Motion to present witnesses in relation to the Motion;

CONSIDERING that it is necessary for the Trial Chamber to be informed of the evidence proposed to be given by any such witnesses in order for it to determine whether it is appropriate to hear such evidence in person, contrary to the usual practice of the Tribunal in relation to interlocutory matters;

NOTING FURTHER the request for an oral hearing on the Motion made by counsel for Brdanin in the Motion and by the prosecution in the Response;

HEREBY ORDERS

  1. counsel for Brdanin, by 4 pm on Thursday 1 June 2000, file statements of the witnesses he wishes to call in relation to the Motion, together with submissions as to why the Trial Chamber should depart from the usual practice of the Tribunal by hearing oral evidence in relation to the Motion;
  2. that the parties, by 4 pm on Thursday 1 June 2000, file submissions as to why the Trial Chamber should depart from the usual practice of the Tribunal by hearing oral argument in relation to the Motion.
