DECISION ON PROSECUTION’S MOTION FOR AN EXTENSION OF TIME IN WHICH TO DISCLOSE ADDITIONAL RULE 70 DOCUMENTS

I, Judge Kevin Parker, the pre-trial Judge in this matter;

NOTING the "Prosecution’s Motion for an Extension of Time in Which to Disclose Additional Rule 70 Documents" filed on 28 February 2005, by which the Prosecution seeks a thirty day extension, until 28 March 2005, to complete its current Rule 70 disclosure ("Motion");

NOTING that during the Status Conference held on 12 October 2004, the Prosecution was given until 28 February 2005 to complete its Rule 70 disclosure;1

NOTING that the Prosecution indicates in the Motion that one of the entities from which permission to disclose Rule 70 material has been sought, has not yet completed its review of the documents, and expects to do so within the next thirty days;

CONSIDERING that in the present case, the Indictment is not yet ready for trial and no trial date has been set, so that some limited delay will not prejudice the trial;

FOR THE FOREGOING REASONS,

GRANT the Motion and ORDER the Prosecution to complete its current Rule 70 disclosure by 28 March 2005.
