I, THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991,

NOTING the Decision on Review of Indictment and Order for Non Disclosure, issued by the Confirming Judge on 24 February 2004;

CONSIDERING that the Registrar has advised me that the indictment will be served on the Defendants on 11 March 2004; and

CONSIDERING that Rule 62 of the Rules of Procedure and Evidence of the International Tribunal ("Rule 62") provides, inter alia, that "SuCpon transfer of an accused to the seat of the Tribunal, the President shall forthwith assign the case to a Trial Chamber" and "StChe accused shall be brought before that Trial Chamber or a permanent Judge thereof without delay, and shall be formally charged";

HEREBY ASSIGN Case No. IT-03-73-I, The Prosecutor v. Ivan Cermak and Mladen Markac, to Trial Chamber II, composed as follows:

Judge Carmel Agius

Judge Jean-Claude Antonetti

Judge Kevin Parker; and

REQUEST that Trial Chamber II issue an order scheduling the Defendants’ initial appearance under Rule 62.
