I, THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991,

NOTING the Decision on Ivan Cermak’s and Mladen Markac’s Second Motions for Provisional Release, rendered by Trial Chamber II on 14 September 2004;

NOTING the "Ivan Cermak’s and Mladen Markac’s Joint Motion for Leave to Appeal the Trial Chamber’s Decision on Ivan Cermak’s and Mladen Markac’s Second Motions for Provisional Release," filed on 20 September 2004;

CONSIDERING the composition of the Appeals Chamber of the International Tribunal set forth in Document IT/222 of the International Tribunal, dated 17 November 2003;

CONSIDERING Articles 12(3) and 14(3) of the Statute of the International Tribunal and Rules 72(B)(i) and 72(E) of the Rules of Procedure and Evidence;

HEREBY ORDER that the three-judge bench of the Appeals Chamber in Case No. IT-03-73-AR65.1, The Prosecutor v. Ivan Cermak and Mladen Markac, shall, with immediate effect, be composed as follows:
