TRIAL CHAMBER I, ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal");

NOTING the Prosecution’s Supplementary Information Relating to Sentence filed on 18th November 2003 together with its Confidential Schedule;

NOTING that the Defence’s Response to the Prosecution’s Supplementary Information Relating to Sentence filed on 10th December 2003 refers to the names of witnesses whose names and statements were filed confidentially by the Prosecution;

PURSUANT TO Rule 54 of the Rules;

HEREBY ORDERS as follows:

  1. Henceforth the Defence’s Response to the Prosecution’s Supplementary Information shall be treated as a confidential filing by any individual, group, or entity that has received it.
  2. Any individual, group, or entity that has knowledge of the Defence’s Response to the Prosecution’s Supplementary Information shall not make any use of it and shall not disclose it contents to any other individual, group, or entity.
  3. Any violation of this order may constitute contempt of the International Tribunal, which is regulated by Rule 77 of the Rules of Procedure and Evidence of the International Tribunal.
  4. The Defence shall re-file their Response to the Prosecution’s Supplementary Information Relating to Sentencing using pseudonyms in place of witnesses’ names by Monday 12th January 2004.
