UNMIK authorities
Trial Chamber I ("Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");
NOTING the "Order for Provisional Release" issued on 4 March 2005, whereby the Chamber granted the accused Beqa Beqaj ("Accused") provisional release subject to various terms and conditions including the condition that the Accused "return for Trial in The Hague upon the Chamber’s Order";
NOTING the guarantees provided by the UNMIK authorities on 7 March 2005 to assist the provisional release of the Accused and his return to Pristina Airport;
NOTING that the Chamber has scheduled the commencement of trial on 25 April 2005;
NOTING the Accused’s entitlements in accordance with Article 21, 4 (d) of the Statute;
PURSUANT TO Rules 54 and 65 of the Rules of Procedure and Evidence;
HEREBY ORDERS:
REQUIRES the authorities of UNMIK to ensure that the Accused, along with his passport and other travel documents, is accompanied from his residence to Pristina airport, Kosovo, and be handed over to the Tribunal’s representative at Pristina airport, Kosovo;
DIRECTS the Registrar of the International Tribunal to take all necessary steps to facilitate the Accused’s return to the International Tribunal from Kosovo to the custody of the Tribunal, by, in particular, designating a representative to take over the Accused from the UNMIK representative at Pristina airport, Kosovo, accompanying him on his return flight to the Netherlands, and handing the Accused over at Schiphol Airport (or any other designated airport in The Netherlands) to the Dutch Authorities along with his passport and other travel documents; and
REQUIRES the Dutch authorities to ensure that the Accused is taken to the custody of the Tribunal upon his arrival in The Netherlands.
