I, FAUSTO POCAR, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("International Tribunal"),
NOTING the "Interlocutory Appeal of Decision on Defence Motion Challenging Jurisdiction of the International Tribunal" filed by Rasim Delic on 22 September 2005 against the "Decision on Defence Motion Challenging Jurisdiction of the International Tribunal" rendered by the Trial Chamber on 7 September 2005;
CONSIDERING the composition of the Appeals Chamber of the International Tribunal as set out in document IT/242 issued on 17 November 2005;
NOTING the "Order Replacing a Judge in a Case Before the Appeals Chamber" issued on 18 November 2005 ordering that the five-Judge bench of the Appeals Chamber in this case shall be composed, with immediate effect, as follows:
