6 JUDGE KWON: Could the Registrar please call the case.

7 THE REGISTRAR: Yes, good morning, Your Honour. This is case

8 number IT-04-83-PT, the Prosecutor versus Rasim Delic.

9 JUDGE KWON: Thank you. Can I have the appearances?

10 MR. MUNDIS: Good morning, Your Honour, for the Prosecution, Tecla

11 Henry-Benjamin and Daryl Mundis, assisted by our case manager, Andres

12 Vatter.

13 JUDGE KWON: Thank you, Mr. Mundis.

14 MS. WHITAKER: Good morning, Your Honour, I'm Quincy Whitaker,

15 co-counsel, assisted by Geoff Roberts, legal assistant. May I apologise

16 for Ms. Vidovic being unavailable today.

17 JUDGE KWON: Thank you, Ms. Whitaker.

18 The Chamber is currently seized of the Prosecution motion

19 submission on amended indictment pursuant to Trial Chamber's decision of

20 13th of December in 2005, and as well the second Defence motion alleging

21 defects in the form of the indictment. However, the Trial Chamber, in the

22 same decision, while granting the Prosecution's request to withdraw its

23 proposed amended indictment of -- dated 31st of October last year, so that

24 the Prosecution would be able to have an opportunity to assess the

25 potential impact of the findings in the Hadzihasanovic and Kubura Trial

1 Judgement ordered the Prosecution to submit a new proposed amended

2 indictment within 30 days of the rendering of the Hadzihasanovic

3 Judgement.

4 Therefore, I'm speaking for myself, I'm of the opinion that it

5 would be better for the Chamber to wait and see if the Prosecution is

6 going to file its proposed amended indictment yet again and make

7 determination on the -- any challenges to the indictment altogether. I

8 wonder if it suits -- it will suit the parties as well.

9 MR. MUNDIS: Thank you, Mr. President, Your Honour. That would

10 seem to be a sensible course of action as far as the Prosecution is

11 concerned.

12 JUDGE KWON: Ms. Whitaker?

13 MS. WHITAKER: We agree, Your Honour.

14 JUDGE KWON: Thank you.

15 I think that's the only issue before the Chamber, but I wonder if

16 there is anything for the parties to raise.

17 MR. MUNDIS: Prosecution has nothing further to raise,

18 Your Honour.

19 JUDGE KWON: Ms. Whitaker?

20 MS. WHITAKER: Neither do we, thank you.

21 JUDGE KWON: Then it will conclude our Status Conference. I wish

22 you -- everybody, a very good day today.

23 MS. WHITAKER: Thank you.
