2 [Open session]

3 [The accused entered court]

4 --- Upon commencing at 9.02 a.m.

5 JUDGE MOLOTO: Good morning, everybody.

6 Mr. Registrar, can you please call the case.

7 THE REGISTRAR: Thank you and good morning, Your Honours. This is

8 case number IT-04-83-T, the Prosecutor versus Rasim Delic.

9 JUDGE MOLOTO: Thank you very much.

10 Could we have appearances, please, starting with the Prosecution.

11 MR. MUNDIS: Thank you, Mr. President.

12 Good morning, Your Honours, counsel, and everyone in and around

13 the courtroom. For the Prosecution, Daryl Mundis and Matthias Neuner,

14 assisted by our intern, Jamie Lipton, and our case manager, Alma Imamovic.

15 JUDGE MOLOTO: Thank you very much.

16 And for the Defence.

17 MS. VIDOVIC: [Interpretation] Good morning, Your Honours. Good

18 morning to my learned friends from the Prosecution. Vasvija Vidovic and

19 Nicholas Robson appearing on behalf of General Rasim Delic, together with

20 our legal assistant, Lana Deljkic.

21 JUDGE MOLOTO: Thank you very much, Madam Vidovic.

22 One or two things, perhaps, before we call the witness.

23 There is an oral decision to be read.

24 [Trial Chamber confers]

25 JUDGE MOLOTO: But before we do that, I just wanted to say that we

Page 6234

1 are still continuing pursuant to Rule 15 bis because, again, Judge Harhoff

2 is not available. He's in another case at the moment.

3 The Trial Chamber will now render its proprio motu decision on the

4 admission into evidence of the record of the site visit conducted by the

5 Trial Chamber between the 3rd and the 6th September 2007, pursuant to Rule

6 4 of the Rules of Procedure and Evidence.

7 The Trial Chamber notes that the audio-visual record has been

8 recorded on two DVD discs. Those discs, as well as transcripts thereof,

9 have been provided to the parties and the Bench by the Registry. The

10 audio-visual record and the transcripts are relevant and have probative

11 value in the present trial.

12 Therefore, pursuant to Rules 4, 54, and 89(C) of the Rules of

13 Procedure and Evidence, the Trial Chamber admits them as exhibits of the

14 Trial Chamber. The Registrar is requested to assign an exhibit number to

15 the two DVD discs and a separate exhibit number to the transcripts.

16 Thank you very much.

17 THE REGISTRAR: Your Honours, in light of the oral decision just

18 rendered, the DVD discs will be Exhibit 889 and the record of the

19 transcripts will be Exhibit number 890.

20 JUDGE MOLOTO: And 889 is for the two discs?

21 THE REGISTRAR: The two DVD discs, yes.

22 JUDGE MOLOTO: Thank you very much.

23 And the transcript, 890?

24 THE REGISTRAR: That's correct, Your Honour.

25 JUDGE MOLOTO: Thank you very much.

Page 6235

1 I'm not sure whether any of the parties have any housekeeping

2 matter to raise before we call the witness.

3 Yes, Mr. Neuner.

4 MR. NEUNER: Good morning, Your Honours.

5 Regarding the next witness, I would have an oral motion concerning

6 protective measures, and the Prosecution would be prepared to give a

7 detailed explanation. If we could move for that purpose into private

8 session, please.

9 JUDGE MOLOTO: Can we please move into private session.
