I, THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("International Tribunal"),

NOTING that, by the order of the President of the International Tribunal issued on 16 July 2002, this case has been assigned to Trial Chamber II composed of Judges Florence Mumba, Carmel Agius and Wolfgang Schomburg;

NOTING that, during the Status Conference held on 30 September 2003, the defendant, Miroslav Deronjic, entered a plea of guilty pursuant to Rule 62(vi) and that the Trial Chamber, as constituted above, entered a finding of guilt and instructed the Registrar to set a date for the sentencing hearing pursuant to Rule 62 bis;

NOTING that, as set out in Document IT/220 of the International Tribunal, Judge Wolfgang Schomburg has been assigned to the Appeals Chamber effective today, 1 October 2003, and is therefore no longer a member of Trial Chamber II;

CONSIDERING the need to expedite the sentencing proceedings pursuant to Rule 100 in the present case;

PURSUANT TO Rule 27(C) of the Rules of Procedure and Evidence of the International Tribunal;

HEREBY ASSIGN, with immediate effect, Judge Wolfgang Schomburg to Trial Chamber II for the temporary purpose of conducting the sentencing proceedings in the present case;

AND DETERMINE that Trial Chamber II in case No. IT-02-61-S, The Prosecutor v. Miroslav Deronjic, shall remain as follows:

Judge Carmel Agius

Judge Wolfgang Schomburg
