TRIAL CHAMBER I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 (the "Tribunal");

NOTING the provisional pre-trial calendar discussed during the Status Conference on 11 April 2000;1

NOTING that a Status Conference is scheduled for 10 July 20002, which will commence at 16:00 hours;

INFORMS the Parties that they must be prepared to discuss the following matters:

  1. Disclosure of materials pursuant to Rule 66(A)(ii) of the Rules of Procedure and Evidence (the "Rules") and Rule 68;

  2. Progress towards completing the pre-trial filings required by Rule 65 ter, particularly whether the parties have made any progress in agreeing on undisputed matters of law and fact, pursuant to Rule 65 ter E(ii) and (iii), and, with respect to the Prosecution, the filing of:

    1. a pre-trial brief pursuant to Rule 65 ter (E)(i);

    2. a list of witnesses it intends to call pursuant to Rule 65 ter (E)(iv); and

    3. a list of exhibits it intends to offer pursuant to Rule 65 ter (E)(v);

  1. Possibility of reducing the number of issues in dispute through judicial notice pursuant to Rule 94;

  2. Whether the Defence has sought reciprocal disclosure pursuant to Rules 66(B) and 67(C);3

  3. Whether the accused plans to offer any of the defences pursuant to Rule 67(A)(ii);

  4. Whether the accused will testify or make a statement under Rule 84 bis, and if so when;

  5. Procedure for collecting affidavits or formal statements pursuant to Rule 94 ter;

  6. Possibility of taking some testimony by deposition pursuant to Rule 71 or by video-conference link pursuant to Rule 71 bis; and

  7. Schedule for the submission of reports by expert witnesses pursuant to Rule 94 bis;

SCHEDULES Status Conferences on 6 October 2000, 12 October 2000 and, if necessary, 18 October 2000, in order to discuss the progress of the pre-trial stage of the case further, and with a view to ensure that the Prosecution meets its obligations pursuant to Rule 65 ter (E) by 26 October 2000, at the latest, and that the Defence meets its obligations pursuant to Rule 65 ter (F) by 10 November 2000, at the latest;

ORDERS, with respect to the filing pursuant to Rule 65 ter (E)(iv), that the Prosecution should endeavour not to call more than two witnesses on the same fact;

SCHEDULES the Pre-Trial Conference pursuant to Rule 73 bis on 22 November 2000;

NOTING, furthermore, the Defence’s "Motion for Provisional Release", dated 7 April 2000 and filed on 13 April 2000; the "Prosecutor’s Response to the Defence Motion for Provisional Release" of 20 April 2000; the Trial Chamber’s "Order on the Defence Motion for Provisional Release" of 11 May 2000, scheduling a hearing on 18 May 2000; the "Defence Motion for Continuance of Provisional Release Hearing" of 11 May 2000; and the Trial Chamber’s "Decision Postponing the Hearing on a Motion for Provisional Release" of 17 May 2000, scheduling the hearing on 8 June 2000;

CONSIDERING that at the Motion Hearing on 8 June 2000, counsel for the Defence did not present arguments on the Motion for Provisional Release, and that the Trial Chamber orally granted the Defence until 23 June 2000 to file the necessary documents in support of this Motion;4

NOTING the "Defence Statement on Motion for Provisional Release" of 23 June 2000, and the "Prosecutor’s Further Response to Defence Reply and Documents on Motion for Provisional Release" of 29 June 2000;

INFORMS the Parties that, in addition to the matters listed above, they are to present oral argument on the Motion for Provisional Release during the Status Conference on 10 July 2000.
