I, Judge Hunt, Pre-Appeal Judge in this case;

NOTING the letter of the Registrar sent to counsel for Mario Cerkez ("counsel") limiting the number of working hours for which payment may be claimed by counsel to 300 hours;

NOTING counsel’s letter of 3 September requesting the Registrar to reconsider its decision;

NOTING the Registrar’s letter of 14 October 2002 stating that there was no sufficient justification for the extension of the number of counsel hours for the remainder of the appeal;

BEING SEISED of "Appellant Mario Cerkez’s Motion for review of the Registrar’s 14 October 2002 Decision", filed on 28 October 2002 ("Motion"), whereby counsel claims that the allotment does not suffice to cover the work necessary to complete this appeal;

NOTING that the Motion has been filed before the Appeals Chamber;

CONSIDERING that the present Scheduling Order should not be regarded as an acceptance, explicit or implicit, of the Appeals Chamber’s jurisdiction over this matter;

HEREBY ORDER that

  1. The Registry shall respond to the Motion within ten (10) days as of today’s date.
  2. Cerkez may reply to the Registry’s response and must do so within seven (7) days of the filing of the Response.
  3. In their respective response and reply, the parties are expected to make submissions as to whether there is an appeal from the Registrar’s decision and, if so, to whom that appeal should be directed.
  4. The Registry is ordered in particular to provide in its Response a precise specification of the basis upon which its conclusion was reached that 300 hours would be sufficient for the remainder of this case.
