THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEISED of a "Prosecutor’s Motion for Judicial Notice of Adjudicated Facts" filed by the Office of the Prosecutor ("Prosecution") on 9 March 2000 ("the Motion"), requesting the Trial Chamber to take judicial notice of certain facts contained in Judgements of other Trial Chambers of the International Tribunal,

CONSIDERING that the material contained in Annex A submitted in support of the Motion is not sufficiently precise to permit the Trial Chamber to determine whether the finding upon which the Prosecution seeks to rely is as asserted by the Prosecution,

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY ORDERS as follows:

  1. the Prosecution shall by Monday 17 April 2000 produce the relevant portion of each Judgement, indicating clearly the actual passage(s) relied upon; and
  2. the Defence shall by Monday 15 May 2000 file their responses to the Motion and the additional material to be provided.
