THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of an application made orally by the Defence for the accused Dario Kordic ("the accused") for access to the transcript of closed session testimony of a witness known as witness DQ in the case of The Prosecutor v. Blaskic ("the transcript") on 16 May 2000 ("the Application"),

NOTING the Request of this Trial Chamber to the President Pursuant to Rule 75 (D) ("the Request"), filed on 16 May 2000, and the Order of the President for Release of the Trial Chamber III Request of 16 May 2000 in the Kordic- Cerkez Case to the Original Trial Chamber, filed 25 May 2000, in which the President invites the Registrar to transfer the Request to the Blaskic Trial Chamber,

NOTING the Decision of the Trial Chamber in The Prosecutor v. Blaskic, filed 26 May 2000, authorising the release of the transcript, subject to the granting of protective measures which guarantee mutatis mutandis to the witness the same level of protection as granted in the Blaskic case,

NOTING that in the Blaskic case the testimony of the witness was given in closed session and the transcript was not disclosed to the public,

CONSIDERING that release of the transcript to the Defence in this case is in the interests of justice, subject to the same protective measures as were granted by Trial Chamber I,

PURSUANT to Rule 75 of the Rules,

HEREBY GRANTS the Application and ORDERS that the Registry of the International Tribunal shall immediately provide to the Defence the transcript of witness DQ, subject to the same protective measures as granted by Trial Chamber I, which will continue in full force and effect.
