THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of a confidential request by the defence for Biljana Plavsic filed on 10 December 2002, seeking the continuation of provisional release for the accused as soon as practicable after the sentencing hearing, on the same terms and conditions as set out by the Trial Chamber in its original Decision of 6 September 2001 ("the Request"),

NOTING that the Prosecutor does not object to the Request,

CONSIDERING that the sentencing hearing has now concluded,

CONSIDERING the reasons given in support of the Request, and in the exceptional circumstances of these proceedings,

PURSUANT TO Rule 65 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY GRANTS the Request and ORDERS as follows:

  1. the provisional release of Biljana Plavsic will continue as soon as practicable under the same conditions as set out in the Trial Chamber Decision of 6 September 2001, subject to the necessary arrangements being made by the Registrar of the International Tribunal; and
  2. Biljana Plavsic shall return to the International Tribunal at such time and on such date as the Trial Chamber may order prior to the rendering of the Sentencing Judgement in this matter.
