I, THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the appeals lodged by Radislav Krstic on 14 August 2001 and by the Prosecution on 16 August 2001;

NOTING the order of the Presiding Judge of the Appeals Chamber of 28 September 2001, designating Judge David Hunt as a Pre-Appeal Judge in this case;

NOTING that, pursuant to the order of the President of the International Tribunal of 24 July 2003, Judge Hunt is no longer a member of the Appeals Chamber in this case;

NOTING Article 14(2) of the Statute of the International Tribunal, which provides that the President of the International Tribunal is ex officio the Presiding Judge of the Appeals Chamber;

PURSUANT TO Rule 65 ter and Rule 107 of the Rules of Procedure and Evidence of the International Tribunal;

HEREBY DESIGNATE myself as Pre-Appeal Judge with responsibility for all pre-appeal proceedings in this case.
