This Trial Chamber of the International Criminal Tribunal for the Former Yugoslavia,

NOTING its decision on the joinder of the trials of the accused Dragoljub Kunarac, Radomir Kovac and Zoran Vukovic of 15 February 2000,

CONSIDERING that the case against the accused Zoran Vukovic must be severed from the indictment against the other four accused Gojko Jankovic, Janko Janjic, Dragan Zelenovic and Radovan Stankovic,

NOTING further that some of the count numbers in the indictment against the accused Dragoljub Kunarac and Radomir Kovac are identical to those in the indictment against the accused Zoran Vukovic and the four other accused, Gojko Jankovic, Janko Janjic, Dragan Zelenovic and Radovan Stankovic, and that the indictment against the other four accused is also already part of the public record,

AND CONSIDERING it necessary to prevent confusion of these counts, as well as to avoid the cumbersome process of merging the indictments once more,

HEREBY ORDERS:

  1. The case against the accused Zoran Vukovic is severed from the indictment against the accused Gojko Jankovic, Janko Janjic, Dragan Zelenovic and Radovan Stankovic.
  2. The Prosecution is directed to file forthwith a redacted indictment containing only the facts and charges from the joint indictment as far as they are relevant to the case against the accused Zoran Vukovic.
  3. The Registrar is instructed to assign the case number "IT-96-23/1" to the redacted indictment against the accused Zoran Vukovic.
  4. The indictment against the remaining accused Gojko Jankovic, Janko Janjic, Dragan Zelenovic and Radovan Stankovic shall be assigned the case number "IT-96-23/2" by the Registrar.
  5. The documents in the proceedings against the accused Dragoljub Kunarac, Radomir Kovac and Zoran Vukovic will carry the combined case number "IT-96-23 & IT-96-23/1", together with the usual suffixes regarding the respective stage of the proceedings.
  6. All future filings in the proceedings mentioned under 5. shall bear the combined case number.
