THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of the "Prosecutor’s Submission of a Second Amended Indictment" filed on 6 September 1999 by the Prosecutor, annexed to which is the second amended indictment against Dragoljub Kunarac and Radomir Kovac,

NOTING that Radomir Kovac has pleaded not guilty to counts 61 and 62 of the original indictment against Dragoljub Kunarac, Radomir Kovac and six other accused, confirmed on 26 June 1996, (counts 22 and 23 of the second amended indictment) on 4 August 1999 at his initial appearance,

NOTING that in the second amended indictment two new counts under Article 3 (Violations of the Laws and Customs of War) of the Statute of the International Tribunal for rape and outrages upon personal dignity have been added against Radomir Kovac (counts 24 and 25),

CONSIDERING that Radomir Kovac has not yet pleaded to the new counts,

CONSIDERING that the second amended indictment has not changed substantively as far as Dragoljub Kunarac is concerned,

PURSUANT TO Rule 50 and Rule 62 of the Rules of Procedure and Evidence,

HEREBY ORDERS that Radomir Kovac appear before the Trial Chamber on 24 September 1999 at 16:00 to plead to the new counts.
