I, MOHAMED BENNOUNA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("the International Tribunal"),

HAVING BEEN APPOINTED as pre-appeal Judge in this matter by virtue of an order of the Appeals Chamber dated 16 May 2000;

BEING SEIZED OF the "Motion for Extension of Time to File Appellant’s Brief on Behalf of Vlatko Kupreškic”, filed by the Defence for Vlatko Kupreškic on 11 September 2000 (“the Motion for Extension of Time”);

NOTING the "Order on Motions For Extension of Time", filed 1 August 2000 ("the Order of 1 August");

NOTING that the "Confidential Appellant’s Brief and Motion, pursuant to Rule 115, on Behalf of Vlatko Kupreskic", filed on 5 September 2000, was outside the time-limit prescribed by the Order of 1 August 2000 ("the Appellant’s Brief");

NOTING that pursuant to sub-Rules 127(A)(ii) and 127 (B) of the Rules of Procedure and Evidence the Appeals Chamber may, on good cause being shown, "recognize as validly done any act done after the expiration of a time so prescribed …";

CONSIDERING that the Motion for Extension of Time has shown good cause;

HEREBY ORDERS that the Appellant’s Brief be recognized as validly done.
