I, Mohamed Shahabuddeen, Vice-President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"), exercising the functions of the President pursuant to Rule 21 of the Rules of Procedure and Evidence of the International Tribunal ("Rules"),
NOTING the Request of the Defence Counsel for Zoran Kupreskic, Mirjan Kupreskic, Drago Josipovic, Dragan Papic, and Vladimir Santic for Leave to Appeal Against the Decision of the Trial Chamber dated 15th January 1999, filed 19th January 1999 ("Request for Leave to Appeal");
NOTING that the Request for Leave to Appeal is made pursuant to sub-Rules 73(B)(i) and (ii);
CONSIDERING that sub-Rule 73(B) provides that a bench of three Judges of the Appeals Chamber may consider whether to grant leave on such a request;
CONSIDERING Article 14(3) of the Statute and Rule 27 of the Rules;
CONSIDERING that President Gabrielle Kirk McDonald has withdrawn from hearing this appeal pursuant to sub-Rule 15(A) of the Rules;
HAVING CONSULTED the Judges of the International Tribunal;
PURSUANT to Rule 21 of the Rules;
HEREBY DECIDE to assign the matter of the Request for Leave to Appeal to a bench of three Judges of the Appeals Chamber, composed as follows:
