THE Appeals Chamber of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED OF the "Prosecution’s request for testimony by video-link conference and protective measures" ("First Request") filed confidentially and ex parte on 16 March 2004 as well as the "Prosecution’s request for the issuance of a subpoena ad testificandum and request for testimony by video-link conference" ("Second Request") filed confidentially and ex parte on 16 March 2004;

CONSIDERING that the Prosecution has advanced no reason why both requests needed to be filed ex parte and that the interests of justice require that both the First and Second Requests be filed confidentially but inter partes;

HEREBY DIRECTS the Registrar to file the First and Second Requests confidentially and inter partes;

ORDERS the Appellant Zigic to file a response to the First and Second Requests by 17 March 2004 and the Prosecutor to file a reply, if he wishes to do so, by 18 March 2004, and

REMINDS the Appellants that the information contained in the First and Second Requests as confidentially filed shall not be communicated to any third parties.

Done in English and French, the English text being authoritative.
