DECISION

THE DEPUTY REGISTRAR,

CONSIDERING the Statute of the Tribunal as adopted by the Security Council under Resolution 827 (1993), and in particular Article 21 thereof;

CONSIDERING the Rules of Procedure and Evidence as adopted by the Tribunal on 11 February 1994, as subsequently amended, and in particular Rules 44 and 45 thereof;

CONSIDERING the Directive on Assignment of Defence Counsel (hereinafter "the Directive"), as adopted by the Tribunal on 28 July 1994, as subsequently amended, and in particular Articles 8, 9, 10, 11 (A)(i) and 19(A)(i) and 16 thereof;

CONSIDERING the Code of Professional Conduct for Counsel Appearing Before the International Tribunal (IT/125 REV.1) (hereinafter "the Code of Conduct"), and in particular Articles 9 and 13 thereof;

NOTING the Decision of the Deputy Registrar of 11 December 2003 assigning Mr. Peter Murphy, attorney at law from Texas, as lead counsel to the Accused;

CONSIDERING that on 4 March 2004, Mr. Murphy has requested the assignment of Mr. Gregor Guy-Smith, attorney at law from California, as co-counsel to the Accused;

CONSIDERING that Mr. Guy-Smith is a native English speaker and has more than twenty five years of criminal law experience and, therefore, fulfils the requirements for assignment as counsel set forth in the Rules and the Directive;

CONSIDERING further that Mr. Guy-Smith has become a member of the Association of Defence Counsel and is willing to have his name added to the Rule 45 (B) list of counsel eligible to be considered for assignment to indigent accused;

CONSIDERING that Mr. Guy-Smith has expressed his consent to be assigned as co-counsel to the Accused in a letter to the Registry dated 11 March 2004;

CONSIDERING that in accordance with Article 16(C) of the Directive, at the request of lead counsel, the Registrar may assign a second counsel to assist the lead counsel if it is in the interests of justice to do so;

HEREBY DECIDES to assign Mr. Gregor Guy-Smith as co-counsel to the Accused, effective as of the date of this decision.
