TRIAL CHAMBER II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Chamber");

NOTING "Prosecutor’s Amended Indictment" filed on 22 August 2005 ("Amended Indictment");

NOTING that no request for clarification was filed by the Defence ;

NOTING however that a few matters in the Amended Indictment remained unclear to the Trial Chamber;

NOTING that the Trial Chamber requested further clarifications of paragraphs 16(c), 16(i) and 19, which were communicated orally to the Prosecution and the Defence by a legal officer of the Chamber;

NOTING "Filing of Revised Amended Indictment" filed by the Prosecution, on 22 September 2005 ("Revised Indictment");

NOTING that the Defence has not filed any objections to the amendments in the Revised Indictment;

CONSIDERING that the amendments made to the Amended Indictment are in accordance with the requested clarifications;

FINDING therefore that the amendments are granted and that the Revised Indictment is the operative one;
