I, RICHARD MAY, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"), being the Presiding Judge in this case,

NOTING that the evidence of one witness, Mr. Edward Vulliamy, was given partly in closed session during the proceedings, and that certain exhibits were admitted as confidential exhibits during his testimony,

NOTING that a number of requests have been made in other proceedings for access to the closed session transcript of Mr. Vulliamy’s testimony,

CONSIDERING Rule 81 (B) of the Rules of Procedure and Evidence of the International Tribunal ("Rules") which provides that a Trial Chamber may order the disclosure of all or part of the record of closed proceedings when the reasons for ordering its non-disclosure no longer exist,

CONSIDERING that the reasons for non-disclosure of the transcript no longer exist and that it would be in the interests of justice for the transcript to be released publicly, but that certain of the exhibits, Exhibits nos. 57, 58 and 59, being the witness’s personal notes, should remain under seal,

CONSIDERING that the Office of the Prosecutor ("Prosecution") and the Victims and Witnesses Section of the International Tribunal have no objection to the release of the closed session transcript and that the Prosecution is also of the view that Exhibits nos. 57, 58 and 59 should remain confidential,

CONSIDERING also that Mr. Vulliamy has been informed of the intent to release the closed session transcript and has not raised any objection,

PURSUANT TO Rule 81 (B) of the Rules

HEREBY ORDER that the transcript of the testimony of Mr. Edward Vulliamy, given in closed session on 16 July 1998, be released to the public but that Exhibits nos. 57, 58 and 59 remain confidential.
