THE TRIAL CHAMBER,

NOTING the Defence Motion to Order Provisional Release filed on 9 September 1997 and the response of the Office of the Prosecutor ("the Prosecution") thereto, filed on 23 September 1997,

NOTING the Defence Motion to Strike Portions of the Indictment filed on 11 September 1997 and the Prosecution response filed on 24 September 1997,

NOTING that the Motion to Order Provisional Release was adjourned part-heard on 10 October 1997, pending the submission of medical reports,

NOTING the Order to Provide Notice of Expert Witnesses issued by the Trial Chamber on 11 November 1997,

CONSIDERING the readiness of the parties to proceed with these matters as described to the Trial Chamber in a status conference held on 24 November 1997,

CONSIDERING FURTHER the intention of the Prosecution to seek leave to amend the Indictment against the accused, pursuant to Rule 50 of the Rules of Procedure and Evidence of the International Tribunal ("the Rules");

PURSUANT TO Rule 54 of the Rules

HEREBY ORDERS AS FOLLOWS:

(1) paragraph 1 of the Order to Provide Notice of Expert Witnesses dated 11 November 1997 is hereby varied such that the Defence shall, within seven days, that is, by Monday 1 December 1997, file the reports of all expert medical witnesses to be called by it in relation to the Defence Motion to Order Provisional Release, copies of such reports to be provided both to the Prosecution and to the Trial Chamber;

(2)    the Prosecution shall file its response to such reports within ten days thereafter, that is, by Thursday 11 December 1997;

(3)    by agreement with the parties, further argument on the Defence Motion to Order Provisional Release shall be heard in open session on Friday 19 December 1997;

(4)    the evidence of the expert medical witnesses shall be restricted to cross-examination or clarification, unless exceptional circumstances arise;

(5)    a date for hearing the Defence Motion to Strike Portions of the Indictment and the Prosecution motion for leave to amend the Indictment (if filed) shall be set only after determination by the Trial Chamber of the Defence Motion to Order Provisional Release.
