2 [Open session]
3 [The accused entered court]
4 --- Upon commencing at 9.35 a.m.
5 JUDGE ORIE: Good morning to everyone in and around this
6 courtroom. Madam Registrar, would you please call the case.
7 THE REGISTRAR: Good morning, Your Honours. This is case
8 IT-09-92-T, the Prosecutor versus Ratko Mladic.
9 JUDGE ORIE: Thank you, Madam Registrar.
10 Before we resume the examination of the witness I would like to
11 briefly deal with a few matters.
12 First of all, and surprisingly that it's already done which is
13 highly appreciated by the Chamber, I inform the parties that the
14 verification of the transcript of yesterday has been done and I -- this
15 will be filed so the parties will see all that. There are a few
16 corrections to the translation which we received yesterday, the
17 interpretation, but on the most important sentence which was translated
18 to us as "but probably with the aim of either destroying the enemy or
19 someone else who was positioned there," that part has been slightly
20 corrected and the verified interpretation now is "but probably with the
21 aim of destroying the enemy or someone who was operating there."
22 As you may remember, the issue whether it was "someone who" or
23 "something that." It's now "someone who was operating there," which
24 contradicts the further explanation of the witness.
25 That's one. I'll put it to the witness once he has entered the
Page 25855
1 courtroom.
2 I have a few other matters, mainly related to translations.
3 First, about P6708. On the 28th of August, 2014, during the testimony of
4 Velimir Dunjic, the Prosecution was asked to upload P6708 and the
5 document was marked for identification in order to allow the Defence to
6 compare the original with the translation. The same day, P6708 was
7 uploaded into e-court.
8 Yesterday, the 18th of September, the Defence informed the
9 Chamber through informal communication that it agreed with the
10 translation. P6708 is therefore admitted into evidence.
11 I now deal with translations for Exhibits D591 up to and
12 including D593.
13 On the 23rd of July, Exhibits D591, D592, and D593 were marked
14 for identification pending translation. On the 17th of September, the
15 Defence informed the Chamber, again through informal communication, that
16 the translations have been uploaded into e-court under doc ID 1D09-3706
17 for D591, doc ID 1D09-3687 for D592, and doc ID 1D09-3707 for D593. And
18 subject to the Prosecution's agreement asked the Chamber to connect the
19 translation with the according originals. The same day, the Prosecution
20 informed the Chamber again through an informal communication that it did
21 not object the translations.
22 Madam Registrar, you are instructed to connect the said
23 translation with the according exhibits. Once that's done, D591 and D593
24 are admitted into evidence, and the Chamber would like to know from the
25 Defence -- from the Prosecution whether they still object the admission
Page 25856
1 of D592.
2 MS. BIBLES: We'll advise the Chamber after the next break,
3 Your Honour.
4 JUDGE ORIE: We'll hear from you and then we may decide on D592.
5 We will continue the examination of the witness in private
6 session, but for the witness to enter the courtroom, we first have to
7 move into closed session.
