5 JUDGE ORIE: Good morning to everyone in and around this
6 courtroom.
7 Madam Registrar, would you please call the case.
8 THE REGISTRAR: Good morning, Your Honours. This is case
9 IT-09-92-T, the Prosecutor versus Ratko Mladic.
10 JUDGE ORIE: Thank you, Madam Registrar.
11 Before we allow the Defence to call its next witness, I would
12 like to deal already with one more item on our agenda, which is dealing
13 with the Rule 92 bis motion related to the Prosecution's re-opening of
14 its case.
15 On the 6th of November of last year, the Prosecution tendered the
16 evidence of five witnesses under Rule 92 bis as a -- as part of the
17 re-opening of its case. On the 19th of November, the Defence asked for
18 an extension of 30 days in which to file its response which the Chamber
19 granted in full. On the 20th of November, the Chamber set a new deadline
20 of the 22nd of December. However, the Defence did not filing its
21 response until the 29th of December, having missed the deadline by a full
22 week without requesting a further extension or making any submissions in
23 its response as to why the Chamber should accept its late filing.
24 The Chamber is concerned about the -- this lack of diligence on
25 the part of the Defence. Considering the importance of the matter,

1 however, the Chamber, pursuant to Rule 127, exceptionally accepts the
2 Defence response as timely filed.
3 In addition, the Prosecution sought leave to reply on the 5th of
4 January of this year. The Chamber grants the Prosecution leave to reply
5 and will consider the reply submitted by the Prosecution. In footnote 8
6 of its filing, the Prosecution submits that it recently received
7 Rule 92 bis certifications for the tendered material and that it will
8 disclose these to the Defence in the near future. As the Rule 92 bis
9 verifications are a requirement for admission, the Chamber invites the
10 Prosecution to file them on the record as opposed to only disclosing them
11 to the Defence.
12 Is the Defence ready to call its next witness, which will give
13 his testimony in closed session?
14 MR. LUKIC: Yes, Your Honour.
15 JUDGE ORIE: Then we turn into closed session.
