I, Carmel Agius, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal") and Pre-Trial Judge in these proceedings:

BEING SEISED of the "Defence Request for Review of the Registrar’s Decision from the 25th of September 2002", filed by the Defence of Mile Mrksic, dated 4 October 2002 ("Request"), requesting the Trial Chamber to review the Decision of the Registrar, dated 25 September 2002, filed on 30 September 2002 ("Decision"), pursuant to which the accused should bear the costs of 330 hours of investigative work at pre-trial stage;

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence;

HEREBY INSTRUCT the Prosecution and the Registrar of the Tribunal ("Registrar"), by Wednesday 23 October 2002, to comment on the Request; and

INVITE the Registrar to provide the Trial Chamber with copies of any material upon which he based his Decision.
