THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of Former Yugoslavia Since 1991;
NOTING the Order of 25 January 1997 (the "Order") (Official Record at Registry Page ("RP") D2673-D2671) whereby the Trial Chamber directed the Prosecution and the Defence for each accused person to provide the other parties with timely notice of potential expert witnesses, including the curriculum vitae of the witness and a statement of the area(s) about which the expert witness will testimomy;
NOTING that the Prosecution and the Defence for each accused person were to comply with the terms of the Order by Friday, 31 January 1997 and Friday, 14 February 1997 respectively;
FURTHER NOTING that paragraph 2(iv) of the Order provides that the Trial Chamber may grant an extension of time to file the notice of expert witnesses testimony, if good cause is shown;
CONSIDERING that on 6 May 1997, the Defence for the accused Hazim Delic filed a Motion for Leave to File Out of Time Designation of Expert Witness (the "Motion") (RP D3563-D3561) in which it seeks to designate Mr. Himo Pasic as an expert witness on the law of citizenship of Bosnia;
CONSIDERING that the curriculum vitae of Mr. Himo Pasic and the scope of his testimony is attached to the Motion (RP D3566-D3564);
NOTING FURTHER that in the course of oral argument before the Tribunal on 29 May 1997, the Prosecution stated that it does not object to the Motion;
HEREBY GRANTS the Motion.
