THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEISED of a confidential "Defendant, Sreten Lukic’s Emergency Motion Seeking Provisional Release" filed by counsel for Sreten Lukic ("Defence") on 23 May 2005 ("Motion"),

NOTING that the response of the Office of the Prosecutor ("Prosecution") is due to be filed on or before Monday 6 June 2005,

CONSIDERING that it would be of assistance to the Trial Chamber in determining the Motion to have an independent assessment of the current state of health of the accused and of the possibility of his receiving appropriate care while in the United Nations Detention Unit,

PURSUANT TO Rules 74bis and 126bis of the Rules of Procedure and Evidence of the International Tribunal

HEREBY ORDERS as follows:

  1. the Registrar of the International Tribunal is to obtain and provide to the Trial Chamber, no later than Wednesday, 1 June 2005, a written medical report from the treating cardiologist, indicating: (1) the current condition of the accused; (2) the recommended care and treatment for the accused; and (3) whether, in the opinion of the cardiologist, such care and treatment can be properly and adequately provided while the accused remains in detention in the United Nations Detention Unit; and

  2. the Prosecution may file a response to the Motion within seven days.
