2 [Open session]
3 --- Upon commencing at 2.48 p.m.
4 [The accused entered court]
5 JUDGE ANTONETTI: [Interpretation] Madam Registrar, could you call
6 the case number, please.
7 THE REGISTRAR: Good afternoon, Your Honours.
8 This is case number IT-03-67-T, the Prosecutor versus
9 Vojislav Seselj.
10 JUDGE ANTONETTI: [Interpretation] Thank you, Madam Registrar.
11 Today, Tuesday, the 15th of April, 2008. I would like to greet
12 the Prosecution, Mr. Seselj, and everyone else assisting us.
13 Very briefly, as we are waiting to call the witness into the
14 courtroom, there is an issue, or rather, two issues I would like to
15 address, two administrative issues. The first issue concerns Mr. Seselj.
16 In May, we will be hearing the expert witness Riedlmayer. When
17 this witness appears -- as this witness will be appearing, Mr. Seselj,
18 the Chamber would like to know whether you have any additional written
19 submissions. And if that is the case, you have one week at your disposal
20 to provide the Chamber with these written submissions. I should also
21 point out that the expert witness should be testifying on the 20th of
22 May, 2008. You were informed of this fact on the 2nd of April. So if
23 you and your assistants have any additional written submissions that you
24 would like to provide us with that concern the expert report, you have
25 one week at your disposal to provide us with such submissions. That is
Page 6007
1 what I wanted to tell you. It's not necessary to debate the issue, which
2 is a very simple one.
3 So if there are any comments you would like to make, to do so.
4 If you would like to take the floor, do so very briefly, because we have
5 a witness who is waiting to be called into the courtroom.
6 THE ACCUSED: [Interpretation] As far as I can remember,
7 Your Honour, I provided a written submission in good time, and I said
8 that I was contesting the expert and his expert report. I was contesting
9 his qualifications. There's nothing new I have to say.
10 JUDGE ANTONETTI: [Interpretation] I take note of what you've
11 said.
12 And the second issue I would like to deal with very briefly is
13 the following subject: The Prosecution has prepared the 600 binders,
14 pursuant to Rule 68. Mr. Seselj has these binders at his disposal, but
15 the deputy chief of the Detention Unit has said that we should send
16 these -- we shouldn't send these binders before the 22nd of April, given
17 the fact that work is ongoing.
18 Mr. Mundis, on the 22nd of April, I presume that you will provide
19 Mr. Seselj with these 600 binders. Is that correct?
20 MR. MUNDIS: Thank you, Mr. President.
21 Good afternoon, Your Honours, and everyone in and around the
22 courtroom.
23 My understanding is some of the binders went previously. The
24 remaining binders are -- there's a second group of binders ready to go.
25 We will hold off on that until they're ready at the Detention Unit. And
Page 6008
1 there is a third category of binders from this material that is yet to be
2 done, but I don't expect it would be ready before the 22nd of April in
3 any event. We will not disclose any of that material until the
4 Detention Unit informs us that they're ready to receive it for the simple
5 practical and logistical reasons indicated.
6 JUDGE ANTONETTI: [Interpretation] Very well. They will have to
7 put these binders in a cell that Mr. Seselj will have access to, because
8 I believe that the binders will take up several shelves. So as of the
9 22nd of April, Mr. Seselj, you will have all this material at your
10 disposal.
11 As far as the witness who will be appearing is concerned, he will
12 have protective measures. We will lower the blinds. We'll now call the
13 witness into the courtroom. The Prosecution has three hours and
14 Mr. Seselj has three hours for the cross-examination of the witness, too.
15 Let's lower the blinds, then.
16 Mr. Mundis.
17 MR. MUNDIS: Thank you, Mr. President.
18 Before the witness is brought into the courtroom, I did want to
19 raise one issue concerning the witness with the Trial Chamber and
20 Dr. Seselj. I would ask to do that in private session, before the
21 witness comes into the courtroom.
22 JUDGE ANTONETTI: [Interpretation] Private session, then. Let's
23 go into private session, and we'll lower the blinds at the same time.
