ORDER ON PROSECUTION’S MOTION FOR PROTECTIVE MEASURES

I, MOHAMED BENNOUNA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("the International Tribunal"),

HAVING BEEN APPOINTED as pre-trial Judge in this matter by virtue of an Order of the Trial Chamber dated 3 February 2000,

BEING SEISED of a "Prosecution’s Motion for Protective Measures" filed by the Office of the Prosecutor ("the Prosecution") on 6 July 2000 ("the Motion"), in which the Prosecution requests protective measures in respect of one witness, Keraterm 28, based on reasons specific to the witness,

NOTING the Order issued by the pre-trial Judge on 29 June 2000, which granted protective measures in relation to twelve witnesses, including Keraterm 28, and directed the Prosecution to notify the pre-trial Judge of any successful attempt to contact four witnesses, including Keraterm 28, and at the same time to file a request for protective measures based upon reasons specific to the witness ("the 29 June Order"),

NOTING that the 29 June Order granted, as a precautionary measure, the same protective measures for Keraterm 28 as for the eight other witnesses whom the Prosecution was able to contact,

NOTING that the Defence did not raise objections to the protective measures sought prior to the issue of the 29 June Order,

NOTING also the agreement reached by the Prosecution and the Defence, referred to in the 29 June Order, regarding the time-limit for disclosure of the names of protected witnesses before the commencement of trial,

CONSIDERING the specific reasons given in support of the Motion in relation to witness Keraterm 28,

PURSUANT TO Articles 20 and 22 of the Statute, and Rules 66 (A)(i), 69, 75 and 79 of the Rules,

HEREBY CONFIRM the 29 June Order in respect of witness Keraterm 28.
