THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the oral ruling of the Trial Chamber given on 14 September 2000 on the "Defence Preliminary Motion" filed by the Defence for the accused Dusko Sikirica on 15 August 2000, in which the accused challenged the adequacy and form of the indictment,

NOTING ALSO the date of 6 November 2000 fixed for the commencement of the trial in this matter,

HAVING HEARD the parties at a status conference held on 14 September 2000, at which the question of readiness for trial was discussed,

AT THE REQUEST of the Defence for the accused Dusko Sikirica and with the agreement of the other parties,

HEREBY ORDERS as follow

(1) The date of Monday 6 November 2000 for commencement of trial is hereby vacated;

(2) The revised date for commencement of trial is Monday 22 January 2001;

(3) The Office of the Prosecutor ("Prosecution") shall, by Friday 29 September 2000, file an amended Attachment A to the indictment,

(a) specifying against each incident listed in the first column for the accused Dusko Sikirica:

(i) the time and place of the alleged offences;

(ii) the identity of the victims and of any co-perpetrators;

(iii) in respect of each such incident, the capacity in which the accused is alleged to have participated pursuant to Article 7, paragraph 1, of the Statute of the International Tribunal;

(iv) specifying whether his responsibility was direct (and where possible, specifying the form of participation) or by virtue of his being the camp commander or pursuant to both Article 7, paragraph 1, and Article 7, paragraph 3; and

(b) providing details of the alleged connection between the accused, Dusko Sikirica, and the alleged plan of the Bosnian Serb authorities to expel the Bosnian Muslims and the Bosnian Croats from the municipality of Prijedor.

The amended Attachment shall form part of the indictment against the accused. No changes to the details provided in respect of the other two accused are permitted, other than to conform the numbering of the counts to those in the amended Indictment of 24 August 1999.

(4) The Prosecution shall file the following documents by Friday 13 October 2000:

(a) an amended pre-trial brief relating to all three accused and fulfilling the requirements of Rule 65 ter (E)(i);

(b) a statement of admissions by the parties and matters which are not in dispute fulfilling the requirements of Rule 65 ter (E)(ii);

(c) a statement of contested matters of fact and law fulfilling the requirements of Rule 65 ter (E)(iii);

(d) an amended witness list fulfilling the requirements of Rule 65 ter (E)(iv);

(e) a list of exhibits fulfilling the requirements of Rule 65 ter (E)(v);

(5) The Defence for Dusko Sikirica, Dragan Kolundzija and Damir Dosen shall each file their pre-trial brief pursuant to Rule 65 ter (F) by Friday 3 November 2000; and

(6) The pre-trial conference shall be held on Wednesday 22 November 2000, commencing at 2.30 p.m.
