THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEISED OF a confidential and ex parte "Prosecutor’s Application to Release Non-Public Material to Defence Counsel" filed on 6 June 2001 pursuant to Rules 66 and 68 of the Rules of Procedure and Evidence of the International Tribunal ("the Rules"), seeking permission to disclose non-public testimony as identified therein ("the Protected Material") of Witness K (known as Witness J in the present case) from the case of Prosecutor v. Kvocka and Others to the Defence for the accused Dusko Sikirica, Damir Dosen, and Dragan Kolundzija ("the Application"),

NOTING the confidential and ex parte request, dated 20 June 2001, made in respect of the Protected Material by this Trial Chamber pursuant to Rule 75 (D) of the Rules to Trial Chamber I, the Trial Chamber seized of Prosecutor v. Kvocka and Others,

NOTING that, by its confidential and ex parte order of 25 June 2001, Trial Chamber I authorised the release of the Protected Material referred to in the Application, "subject to Trial Chamber III taking protective measures in regard to the Defence which guarantee to Witness K the same level of protection previously enjoyed",

PURSUANT to Rule 75 of the Rules,

HEREBY GRANTS the Application, RELEASES the Protected Material, EXTENDS to the Protected Material the protective measures indicated by Trial Chamber I in its oral order of 3 May 2000 in Prosecutor v. Kvocka and Others, and CONFIRMS the protective measures already imposed by this Trial Chamber in respect of Witness J and extends them to the Protected Material.
