I, Claude Jorda, President of the International Criminal Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 (hereinafter "the Tribunal"),

NOTING the appointment of Judge Mohamed El Habib Fassi Fihri by the United Nations Secretary-General pursuant to Article 13(3) of the Statute of the Tribunal (hereinafter "the Statute"),

NOTING that Judge Mohamed Bennouna resigned on 28 February 2001,

PURSUANT to Article 14(C) of the Statute and Rule 27 of the Rules of Procedure and Evidence of the Tribunal,

FOR THE FOREGOING REASONS,

APPOINT Judge Mohamed El Habib Fassi Fihri to Trial Chamber III to replace Judge Mohamed Bennouna,

CONFIRM that, in the proceedings against Simic et al (case no. IT-95-9-PT), Trial Chamber III shall be composed as follows:
