I, Gabrielle Kirk McDonald, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING my Order of today ("Order of the President Assigning A Case to a Trial Chamber", 17 February 1998, The Prosecutor v. Miroslav Tadic, alias Miro Brko, and Milan Simic, IT-95-9-I, Official Record at Registry Page 408-409) assigning this matter to Trial Chamber I, composed of Judge Claude Jorda (Presiding), Judge Fouad Riad and Judge Almiro Rodriguez;

NOTING that the Initial Appearances of Miroslav Tadic, alias Miro Brko, and Milan Simic, pursuant to Rule 62 of the Rules and Procedure and Evidence of the International Tribunal ("Rules"), shall be held today before the above-constituted Trial Chamber I;

NOTING FURTHER the illness of Judge Fouad Riad;

CONSIDERING Rule 15 (E) of the Rules, which vests in me the power to authorise, in case of illness or an unfilled vacancy or any other exceptional circumstances, a Chamber to conduct routine matters, such as the holding of an initial appearance under Rule 62, in the absence of one or more members of that Chamber;

HEREBY DECIDE, pursuant to Rule 15 (E), to authorise Trial Chamber I to conduct the hearing of the aforementioned Initial Appearances in the absence of Judge Fouad Riad.
