DECISION ON THE APPLICATION OF THE ACCUSED MILAN SIMIC TO LEAVE HIS PLACE OF RESIDENCE FOR MEDICAL REASONS (3)

I, Claude Jorda, Presiding Judge of Trial Chamber I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed on the Territory of the Former Yugoslavia since 1991 (hereinafter the "Trial Chamber"),

NOTING the Decision for provisional release of the accused dated 26 March 1998,

NOTING the application of the Defence filed on 22 July 1998 seeking a change in the judicial supervision of the accused Milan Simic for medical reasons (hereinafter the "Application") so that he may be permitted to receive treatment, and the medical certificate attached to that Application,

PURSUANT to Rule 54 of the Rules of Procedure and Evidence (hereinafter "the Rules"),

NOTING that the medical certificate attached to the Application indicates that treatment in a specialised institution specifically identified as being located in Igalo would be beneficial to the medical condition of the accused,

NOTING that the facsimile sent to the Registry by Igalo Hospital states that it is prepared to admit the accused for the period 9 to 24 August, 1998,

FOR THE FOREGOING REASONS,

AUTHORISE exceptionally the accused to leave his residence in Bosanski Samac to receive medical treatment in that hospital for the period strictly necessary for the treatment, that is, from 8 to 25 August 1998 inclusive,

ORDER that the accused and his Counsel inform the Registry of the telephone number of Igalo Hospital so that Registry may verify the presence of the accused in that institution,

ORDER that the accused report to the local police in Bosanski Samac on 8 August and 26 August 1998,

ORDER that the local police of Bosanski Samac submit a report by 15 September 1998 at the latest in which it states that judicial supervision has been duly effected for the period 26 March to 27 August 1998.
