THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the "Notice of Motion for Judicial Assistance" in connection with the Peace Stabilisation Force ("SFOR") or other military and security forces operating on the territory of Bosnia and Herzegovina ("the Application"), filed by the Defence for the accused, Stevan Todorovic, on 24 November 1999, seeking the assistance of the Trial Chamber in obtaining information and documents in connection with the evidentiary hearing to be held on a “Motion for an order directing the Prosecutor to forthwith return the accused Stevan Todorovic to the country of refuge” and “Accused Stevan Todorovic’s Petition for a Writ of Habeas Corpus”, both filed by the Defence for Stevan Todorovic on 21 October and 15 November 1999 respectively;

NOTING the "Scheduling Order for Hearing on Defence Motion for Judicial Assistance", issued by the Trial Chamber on 1 June 2000 ("Scheduling Order") which ordered that the Application be served upon SFOR, permitted SFOR to file a written response to the Application by Friday 16 June, and scheduled a hearing of the Application for Friday 23 June 2000;

NOTING the letter, dated 16 June 2000 and addressed to the Presiding Judge of this Trial Chamber from the Legal Advisor to SFOR, in which a request is made on behalf of SFOR to postpone by 30 days the date by which SFOR may file a written response to the Application pursuant to Order (2) of the Scheduling Order;

HEREBY ORDERS THAT:

  1. If SFOR intends to file a response to the Application, it file with the Registry of the International Tribunal, by 4pm on Wednesday 28 June 2000, a document stating the reasons for its request for the postponement of the date set for the filing of that response;

  2. The counsel for the accused in these proceedings and the Office of the Prosecutor may file a response to any document filed by SFOR pursuant to paragraph (1) above within seven days of the filing of that document;

  3. Order (2) of the Scheduling Order is varied to postpone the date by which SFOR is to file a written response to the Application until further order;

  4. Order (3) of the Scheduling Order is varied to postpone the date and time of the hearing of the Application until further order.
