THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

Proprio motu

NOTING the confirmation on 22 November 2001 of the indictment against the accused in Case No. IT-01-51,

NOTING the statement by the Prosecutor at the hearing held on 29 October 2001 in Case No. IT-99-37 and Case No. IT-01-50 that, following the confirmation of the indictment in Case No. IT-01-51, the Office of the Prosecutor ("Prosecution") would be making an application for joinder of these three cases and the instruction of the Trial Chamber for such application to be filed within seven days of the confirmation, if any, of the new indictment,

NOTING the designation of amicus curiae by the Registrar of the International Tribunal in Case No. IT-99-37 on 6 September 2001 and on 31 October 2001 in Case No. IT-01-50,

NOTING the Order of the Trial Chamber of 13 September 2001 in Case No. IT-99-37 regulating the filing of motions and requiring all parties and the amici curiae to respond to motions within fourteen days of the filing of such motions,

PURSUANT TO Rules 54 and 126 of the Rules of Procedure and Evidence of the International Tribunal

HEREBY ORDER as follows:

(1) The Prosecution shall have until the close of business on Tuesday 27 November 2001 to file any application for joinder of these three cases;

(2) the application for joinder shall be served upon the amici curiae who shall have until 12 noon on Monday 10 December 2001 to file their responses, if any; and

(3) oral argument on the Motion shall be heard on Tuesday 11 December 2001.
