DECISION GRANTING THE PROSECUTOR’s MOTION FOR EXTENSION OF TIME

I, Amin El Mahdi, Judge at the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of The Former Yugoslavia since 1991;
BEING DESIGNATED as Pre-Trial Judge in the case The Prosecutor vs. Radovan Stankovic (“the Accused”);
NOTING the "Scheduling Order for Submission of Pre-Trial Briefs and Holding a Pre-Trial Conference", issued by me on 1st September 2003, in which I set the date for submission of the Prosecution’s Pre-trial Brief for Monday, 6th October 2003;
BEING SEIZED of the "Prosecution’s Motion Requesting An Extension of Time to Submit the 65ter(E )(i)(ii)(iii) Filing" ("the Motion"), filed on 25th September 2003, in which the Prosecution requests an additional month to file its pre-trial brief and the pertaining lists of witnesses and exhibits in this case due to internal redeployment of staff to accommodate requirements in other Prosecution teams;
NOTING that the Defence has not filed any response to the Motion within the time-limit set out in Rule 126bis of the Rules of Procedure and Evidence ("the Rules");
CONSIDERING that the extension of time does not affect the fair conduct of the proceedings at this stage;
PURSUANT to Rules 54 and 65ter of the Rules;
HEREBY GRANT the Motion; and
ORDER
Done in both English and French, the English text being authoritative.
