THE REFERRAL BENCH of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal");
NOTING the "Request by the Prosecutor under Rule 11 bis of the Rules of Procedure and Evidence (RPE) for Referral of the Indictment to the State of Bosnia and Herzegovina," ("the Request"), Partly Confidential and Ex Parte dated 21 September 2004, wherein the Prosecution requests an order that the protective measures granted to victims and witnesses as set out in Confidential Annex II of the Request apply and remain in force;
NOTING that the Request contains in Confidential Annex III a witness pseudonym key for convenience in identifying the victims and witnesses referenced in Confidential Annex II;
PURSUANT to Rule 11 bis (D)(ii) of the Statute of the Tribunal;
HEREBY ORDERS that the protective measures provided for the named victims and witnesses in Confidential Annexes II and III of the Prosecution’s Request, incorporated herein, shall remain in force.
