I, CLAUDE JORDA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

 

NOTING Rule 22 (A) of the Rules of Procedure and Evidence of the International Tribunal ("Rules"), which provides that "If neither the President nor the Vice-President remains in office or is able to carry out the functions of the President, these shall be assumed by the senior permanent Judge, determined in accordance with Rule 17 (C)";

CONSIDERING the temporary absence of the President and the Vice-President;

CONSIDERING that in accordance with the criteria set out in Rule 17(C) of the Rules, I am the most senior Judge at the International Tribunal and, therefore, during the period of absence of the President and Vice-President, I assume the functions of the President;

NOTING the "Ordonnace du Président relative à la composition d’une chambre de première instance pour une affaire" filed on 23 November 2001 assigning this case to Trial Chamber I composed of Judge Liu, Judge Amin El Mahdi and Judge Alphonse Orie;

CONSIDERING the "Decision on Prosecution’s Motion for Extension of Time" filed on 19 August 2003, which, inter alia, scheduled the commencement of the trial in this case for 9 October 2003;

CONSIDERING the letter of the Secretary-General of the United Nations dated 25 August 2003, appointing Judge Joacquín Martín Canivell, effective 26 August 2003, to sit as an ad litem Judge in the present case;

CONSIDERING Rule 62 of the Rules, which requires the President to assign cases to Trial Chambers, and Rule 19(A) of the Rules, which authorizes the President to coordinate the work of the Chambers;

PURSUANT TO Articles 12(2), 13ter(2) of the Statute of the International Tribunal and Rule 22(A), Rule 17(C), Rule 62 and Rule 19(A) of the Rules;

HEREBY ORDER that in case no. IT-01-42-PT, The Prosecutor v. Pavle Strugar & Miodrag Jokic, Trial Chamber I shall be composed, with immediate effect, as follows:
