TRIAL CHAMBER I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEIZED of the "Defence Motion for the Extension of Time" ("the Motion"), filed on 22 July 2002, by which the Defence requests to be granted leave to file a response to the Prosecution’s amended indictment filed on 26 July 2002 by 30 August 2002;

CONSIDERING that the Defence submits that on 11 July 2002 the Trial Chamber gave additional time to the Prosecution to file its amended indictment, postponing thus the deadline of the Defence to file its response to the amended indictment to a time when the Tribunal is in recess; that as a result, "the Defence’s access to the resources of the Tribunal and all other resources is gravely impeded"1;

CONSIDERING that during the Tribunal’s period of recess, no hearings are scheduled; that during that time, the Tribunal is functioning normally and full access to the Tribunal’s resources is guaranteed to the Defence; that however, at this stage of the case, granting additional time to the Defence to file its response would not impede the best interests of justice;

PURSUANT to Rule 127 of the Rules of Procedure and Evidence;

HEREBY GRANTS the Motion and enlarge the time prescribed to the Defence to file its response to the amended indictment filed by the Prosecution on 26 July 2002 to 30 August 2002.

Done in English and French, the English text being authoritative.

Dated this thirty-first day of July 2002,
At The Hague,
The Netherlands.
