The Office of the Prosecutor:

Ms. Susan Somers

 Defence Counsel:

 Mr. Goran Rodic

TRIAL CHAMBER I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEIZED of the "Defence Request for Leave to Reply and Extension of Time" ("the Request"), filed on 5 February 2002, by which the Defence requests to be granted leave to file a reply to the Prosecution’s response to the Defence Motion on the form of the indictment and challenging jurisdiction, and to be authorised to file its Reply by 15 February 2002;

NOTING that the Prosecution Response to the Defence Motion on the Form of the Indictment was filed on 1st January 2002 ("the Response");

NOTING that, on 6 February 2002, the Prosecution filed a "Consolidated Corrigenda and Supplemental Sourcing to Prosecution’s Responses to Defence Preliminary Motions Alleging Defects in the form of the Indictment and Challenging Jurisdiction" ("the Corrigenda");

CONSIDERING that, in this instance, there is no reason to dismiss the Request since the rights of the parties are preserved and that granting the Request would best serve the interest of justice, particularly in light of the date when the Corrigenda were filed;

PURSUANT TO Rule 126 bis and 127 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY GRANTS the Request and further ORDERS as follows:

Done in both English and French, the English text being authoritative.
