THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal");
NOTING the Trial Chamber Decision on Request for the Pre-Trial Provisional Release issued on 30th November 2001 in which the Trial Chamber granted the accused, Pavle Strugar, provisional release subject to various terms and conditions including under the condition that "the accused shall return into the custody of the Tribunal at a time and date the Chamber will determine";
NOTING that the Trial Chamber has scheduled the pre-trial conference for 8th October 2003 and the commencement of trial on 9th October 2003;
NOTING the Accused’s entitlement in accordance with Article 21, para. 4 (d);
PURSUANT TO Rules 54 and 65 of the Rules of Procedure and Evidence;
HEREBY ORDERS
DIRECTS the Registrar to take all necessary steps to facilitate the Accused’s return to the Tribunal and to ensure his custody in the Detention Unit; and
REQUIRES the Government of Serbia and Montenegro to ensure that a designated official accompanies the Accused on his return flight to the Kingdom of the Netherlands and hands the Accused over to the Dutch Authorities upon the arrival of the Accused’s flight in The Netherlands on Monday 6th October 2003.
