I, Gabrielle Kirk McDonald, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

NOTING the Appeals Chamber’s Scheduling Order of 27 August 1999 in which it ordered that the parties to the present appeal be heard on the matter of sentencing forum on this day ("Oral Hearing");

NOTING that, due to infirmity, Judge Wang Tieya will not be able to attend the Oral Hearing;

CONSIDERING that Sub-rule 15(E) of the Rules of Procedure and Evidence of the International Tribunal vests in me the power to authorise a Chamber to conduct routine matters in the absence of one of its members;

HEREBY AUTHORISE the Appeals Chamber, composed of Judge Mohamed Shahabuddeen, Presiding, Judge Antonio Cassese, Judge Rafael Nieto-Navia and Judge Florence Ndepele Mwachande Mumba to conduct the Oral Hearing in the absence of Judge Wang Tieya.
