THIS APPEALS CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEISED of an oral application made by counsel for Mr. Milan Vujin in these proceedings on 10 September 1999 ("the Motion") seeking protective measures in respect of certain of the witnesses to be called on behalf of Mr. Vujin,

HAVING HEARD the arguments of the parties in respect of the witnesses in open session on  10 September 1999,

CONSIDERING that the relief requested in the Motion is appropriate for the safety, security or non-disclosure of the identity of these and other witnesses in these proceedings,

HAVING GRANTED THE MOTION orally on 10 September 1999,

PURSUANT TO RULES 75 and 79 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY CONFIRMS THE ORDERS as follows:

  1. the pseudonyms DA, DB, DC and DD shall be used whenever referring to these witnesses in proceedings before the International Tribunal and in discussions among parties to the proceedings;
  2. the testimony of witnesses DA, DB, DC and DD shall be heard in closed session; edited records and transcripts of the sessions shall be released to the public and to the media only after review by the Victims and Witnesses Section and redaction of any identifying information;
  3. the name, address, whereabouts and other identifying information concerning witnesses DA, DB, DC and DD shall be sealed and not included in any of the public records of the International Tribunal created after this date;
  4. documents of the International Tribunal created after this date and which identify witnesses DA, DB, DC and DD shall not be disclosed to the public or the media; and
  5. the public and the media shall not photograph, video-record or sketch the protected witnesses while the witnesses are in the precincts of the International Tribunal.
